It is close to a magic show where the magician tries to convince the audience he has real powers. One needs a test that one can tell more objectively if there is intelligence present. Your points about non-physical minds raise important questions. Any theory about them needs to show what has a mind controlling it and what doesn't. The same would apply to strong AI. One of Searle's objections to it was that everything is mental including thermostats.
